ADA Grievance and Complaint Procedure

The Accessibility Resource Center (ARC) works to ensure the rights of students with disabilities access to accommodations/academic adjustments in accordance with the Americans with Disabilities Act (ADA) and the Rehabilitation Act of 1973, Section 504. Our office works to encourage self-advocacy and the right to pursue a grievance.  Students are encouraged to try and resolve grievances at the appropriate level of dispute.  If all attempts are unsuccessful or not satisfactorily resolved please follow the process below:

  1. Submit in writing to the ARC Director within five working days of the original incident a clear detailed account with the date, time, location, parties involved, witnesses, attempts to resolve the grievance, including the desired resolution. This should include any documentation of the incident that supports your desired resolution should be attached.
  2. The ARC Director will conduct an investigation of events leading up to the grievance. Within five working days the director will then work to set up a meeting with the student to finalize a determination and resolution.
  3. If a satisfactory resolution is not apparent after completing step two, the grievance will then be forwarded to the Executive Director – Health, Wellness and Accessibility at this time for a resolution.  The decision of the Executive Director – Health, Wellness and Accessibility is final.

Our office values your feedback and will make every attempt to provide a quick and timely resolution. If you have any accommodation request or issues with accessibility in navigating the grievance process please notify our office in writing of your request and we gladly will work to provide reasonable accommodations.

Rights and Responsibilities

Employees with Disabilities

Staff and Faculty with disabilities at Â鶹ÊÓƵ must make their need for accommodation known to their supervisor or the Director of Human Resources – Employee Relations (ADA Coordinator.)

Grievances involving allegations of discrimination under federal and state law must also be reported the directly to the Director of Human Resources – Employee Relations.

Disability Documentation and Confidentiality

The Accessibility Resource Center at Â鶹ÊÓƵ is the custodian of records for students medical records obtained for the purpose of determining and providing reasonable accommodations/academic adjustments.

Disability and medical information is confidential and is not shared except where disclosure is required by law or is necessary to facilitate legitimate University processes, including granting appropriate reasonable accommodations/academic adjustments, addressing direct threats or investigating claims or charges.
